1Introduction

Welcome to Draw & Learn (“Application,” “App,” “Service”). These Terms and Conditions (“Terms”) govern your access to and use of the App operated by Epsilon Developers. By downloading, installing, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.

Where a user is below the age of legal consent applicable in their jurisdiction, a parent or legal guardian must review and accept these Terms on the child’s behalf.

3Description of the Application

Draw & Learn is an educational drawing and learning platform designed primarily for children. The App may include guided drawing lessons, educational content, interactive learning activities, drawing-recognition features, progress tracking, rewards systems, educational worlds and levels, user-created artwork, premium educational content, and advertising-supported features. It is intended for educational and entertainment purposes.

4Eligibility

The App may be used by children under the supervision of a parent or legal guardian. Parents and guardians are responsible for supervising use, monitoring purchases, managing device permissions, reviewing privacy disclosures, maintaining parental controls, and ensuring compliance with applicable laws. Users represent that they have the legal authority necessary to accept these Terms.

5Acceptable Use

Users agree to use the App only for lawful and intended purposes. Users shall not: use the App in violation of applicable laws; attempt unauthorized access to systems or services; circumvent security mechanisms; interfere with operation of the App; misuse premium functionality; engage in fraudulent activity; use automated tools to exploit the App; or attempt to manipulate rewards or progression systems.

6Educational Content Disclaimer

The App is intended to support creativity, learning, and educational engagement. However, Epsilon Developers does not guarantee educational outcomes, learning improvements, academic performance, skill mastery, or drawing proficiency. Individual results may vary significantly. The App should not be considered a substitute for formal education, professional instruction, or educational assessment.

7User-Generated Artwork

Users may create original artwork using the App. Subject to applicable law: users retain ownership of artwork they create; the App may store artwork locally on the device; users are responsible for content they create and share; and Epsilon Developers does not claim ownership of original user-created artwork. The App may process artwork as necessary to provide drawing-recognition functionality and educational features.

8Local Data Storage

The App may store drawings, educational progress, coins, stars, achievements, settings, and draft content primarily on the user’s device. Users are responsible for maintaining backups where desired.

9Drawing Recognition Functionality

The App includes drawing-recognition technology designed to evaluate similarity between user drawings and educational templates. Recognition results are generated automatically, are intended for educational purposes, may not always be accurate, and should not be considered objective assessments of artistic ability. Users acknowledge that recognition scores are estimates and may vary.

10Advertisements

The free version of the App may display advertisements supplied by third-party advertising providers. Users acknowledge that advertising content may vary, that Epsilon Developers does not control all advertisement content, that availability may change without notice, and that third-party advertisements may be governed by separate terms and privacy policies. Premium removes advertisements.

11Premium Features and Purchases

The App may offer premium content, upgrades, or additional features. Purchases may be processed through Razorpay, Google Play Billing, or Apple In-App Purchases. Prices may change from time to time. Premium purchases grant a limited right to access purchased features and do not transfer ownership of any intellectual property. Refunds are governed by applicable law, platform policies, and payment-provider policies — see our Refund Policy.

12Intellectual Property

All intellectual property rights in the App remain the exclusive property of Epsilon Developers and its licensors. Protected materials include, without limitation:

13Third-Party Services

The App may integrate with third-party services including Google Play Services, Google AdMob, Apple Services, Razorpay, and other operational, security, or analytics providers. These services operate under their own terms and policies. Epsilon Developers is not responsible for third-party services except where required by law.

14Updates and Modifications

Epsilon Developers may modify, update, suspend, replace, or discontinue portions of the App at any time. Updates may include new features, bug fixes, security improvements, content changes, and design modifications. Continued use of the App after updates constitutes acceptance of the modified version.

15Account and Access Limitations

The App may operate without requiring user accounts. Where future features introduce account functionality, users must provide accurate information and maintain account security. We reserve the right to restrict access where necessary to protect security, prevent abuse, enforce these Terms, or comply with legal obligations.

16Privacy

Use of the App is also governed by our Privacy Policy, Children’s Privacy Notice, and Data Deletion Policy. Users and parents should review these documents carefully.

Users agree to indemnify and hold harmless Epsilon Developers, its operators, affiliates, contractors, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from violation of these Terms, misuse of the App, violation of applicable laws, or infringement of third-party rights.

20Termination

We may suspend, restrict, or terminate access to the App if these Terms are violated, fraudulent activity is detected, security risks arise, or legal obligations require action. Termination does not affect rights or obligations that accrued prior to termination.

21Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The applicability of conflict-of-law principles is excluded to the extent permitted by law.

22Dispute Resolution

Before initiating formal legal proceedings, the parties agree to attempt to resolve disputes through good-faith discussions. If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts located in India.

23Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

24Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of any rights.

25Entire Agreement

These Terms constitute the entire agreement between the user and Epsilon Developers regarding the App and supersede all prior understandings, communications, and agreements relating to the App.

26Changes to These Terms

We may revise these Terms from time to time. Updated versions will be made available through the App or associated platforms. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
