1Introduction
Epsilon Developers respects the intellectual-property rights of others and expects users, partners, licensors, and third parties to do the same. This Policy establishes procedures for reporting alleged infringements relating to copyright, trademark, trade dress, design rights, database rights, proprietary educational content, and other intellectual-property rights. It applies to the Draw & Learn mobile application, related websites and services, educational content, user-generated content, marketing materials, and associated digital properties.
2Operator Information
Draw & Learn is owned and operated by Epsilon Developers (Anurag Mahajan & Satyam Kushwaha). For IP complaints, email contact@epsilondevelopers.xyz with the subject line “DMCA / Intellectual Property Complaint”.
3Our Intellectual Property Commitment
Epsilon Developers is committed to respecting intellectual-property rights, investigating valid complaints, removing infringing materials when appropriate, protecting legitimate rights holders, providing fair review procedures, and complying with applicable laws. We reserve the right to take action against infringing activities consistent with applicable law.
4Types of Complaints Accepted
We may review complaints relating to copyright infringement (e.g., unauthorized copying of educational content, lessons, artwork, software code, or graphics), trademark infringement (e.g., unauthorized use of logos or brand names, confusingly similar marks, misrepresentation of affiliation), design and trade-dress infringement (e.g., copying of visual designs or proprietary interfaces), and other intellectual-property rights (database rights, proprietary educational frameworks, protected visual assets, and proprietary learning structures).
5Filing a Copyright Complaint
If you believe copyrighted material has been used in a manner that infringes your rights, submit a written complaint containing:
- Full legal name of the copyright owner.
- Contact information (email, mailing address, phone if available).
- Description of the copyrighted work claimed to be infringed.
- Description and location of the allegedly infringing material.
- Evidence supporting ownership.
- A good-faith statement that the disputed use is not authorized.
- A statement that the information provided is accurate, and (where applicable) a statement under penalty of perjury that you are authorized to act on behalf of the rights holder.
- A physical or electronic signature.
6Filing a Trademark Complaint
Trademark complaints should include the trademark owner’s name, registration details and jurisdiction (if applicable), a description of the mark, a description and location of the alleged infringement, supporting evidence, contact information, and a signature.
7Filing Other Intellectual-Property Complaints
For IP rights other than copyright or trademark, please provide a description of the right claimed, evidence of ownership, a description and location of the alleged infringement, relevant registrations or documentation, contact details, and a signature.
8Review Procedure
Upon receipt of a complaint, Epsilon Developers may review it, request additional information, investigate the allegations, temporarily restrict access, remove disputed materials, reject unsupported complaints, or escalate the matter for legal review. We reserve sole discretion regarding the investigation process, and submission of a complaint does not guarantee removal of content.
9Counter-Notification Procedure
If content is removed or restricted based on a complaint, the affected party may submit a counter-notification including their full legal name, contact information, identification of the removed content, a statement explaining why removal was improper, supporting evidence, a good-faith statement that the content was removed due to mistake or misidentification, and a signature. Counter-notifications may be shared with the original complainant where legally permitted.
10Actions We May Take
Following investigation, we may remove or restore content, restrict access, suspend accounts or access privileges, issue warnings, decline action, refer matters to legal counsel, or cooperate with law enforcement or regulators where legally required. The nature of the response will depend on available evidence and applicable law.
11Repeat Infringement Policy
Where appropriate, Epsilon Developers may suspend, restrict, or terminate access for users who repeatedly engage in intellectual-property infringement. Factors considered may include the number of complaints, severity of conduct, supporting evidence, prior violations, and applicable legal obligations.
12False, Fraudulent, or Misleading Complaints
Knowingly submitting false, fraudulent, misleading, or abusive complaints may result in rejection of the complaint, restriction of future submissions, suspension of communications, recovery of costs where permitted, and legal action where appropriate. Complainants are solely responsible for the accuracy of submitted information.
13Protection of Epsilon Developers’ Intellectual Property
Epsilon Developers actively protects its intellectual-property rights, including software assets (source/object code, recognition algorithms, architecture, databases), educational assets (lesson structures, frameworks, progression systems, world architecture, content), creative assets (illustrations, templates, mascots, animations, graphics, UI designs), and brand assets (the Draw & Learn name, logos, branding, and marketing assets). Unauthorized reproduction, redistribution, commercialization, extraction, or cloning may result in legal enforcement actions.
14AI Training and Dataset Restrictions
Without express written authorization, no person or organization may use content from Draw & Learn for AI training, machine-learning model development, dataset creation, generative-AI systems, neural-network training, or automated content generation. This applies to educational content, illustrations, templates, recognition outputs, databases, mascots, and branding materials. Nothing in this Policy grants permission for AI-related use.
15International Compliance
Draw & Learn may be distributed internationally. Complaints may be reviewed in accordance with applicable copyright and trademark laws, international IP treaties, platform requirements, and relevant jurisdictional obligations. The availability of specific legal remedies may vary by jurisdiction.
16Limitation of Responsibility
Epsilon Developers does not guarantee immediate action on complaints, removal of all disputed material, resolution in favor of any party, or legal determinations regarding ownership. Determinations made under this Policy are administrative decisions and do not constitute legal judgments.
17Policy Modifications
We reserve the right to modify this Policy at any time. Updated versions become effective upon publication unless otherwise stated. Continued use following publication constitutes acceptance of the revised Policy where legally permissible.
